The Schwartz Law Firm is investigating claims against Carlos Cortez (“Cortez”) and Cortez Wealth Advisors, LLC (“CWA”) for facilitating investments in Bullet Capital & Contract Occurrence Management Merchants (“BCCOMM”). We understand that Cortez sold and/or recommended BCCOMM to many of his clients and described the investment as a fund that invests “pooled funds” into various crypto currency. However, this was not the case and it appears that BCCOMM may be a sham. We further understand that Cortez did not disclose to his clients that BCCOMM was under investigation by the Commodity Futures Trading Commission (“CFTC”) for violation of Section 6(c)(1) of the Commodity Exchange Act, 7 U.S.C. § 9(1), and Commission Regulation 180.1(a), 17 C.F.R. § 180.1(a).
In its September 1, 2020 Complaint, the CFTC alleges, among other things, that BCCOMM, “intentionally or recklessly made false or misleading statements regarding being regulated by the NFA.” We believe many investors may have been induced by Cortez to purchase BCCOMM after the CFTC’s Complaint against BCCOMM was filed. It is further believed that Cortez failed to complete sufficient due diligence prior to recommending BCCOMM to his clients.
